I am 29 yrs old working woman. I love my husband very much. Many times my husband comes late from his work. If I am asleep he makes me awake and we end up having sex. Its very usual because most of the times he comes late. Last night when I was asleep my sister's husband came to me.

He made me awake by fingering me. He was silent all that time. I was unable to realise him in the dark and co-operated with him. After he ended inside of me I've realised him by his voice but he was done by then. He told me to forget what he did. He said he liked me too much and was not able to control his urge. I felt very guilty and scolded him. I think its my fault, I must have realised him. Should I tell it to my husband and sister?

well what happened to you can be characterized as rape , the indian law will recognize it like that , you were taken advantage of and the fact that u will not tell anybody gave ur brother in law the guts to do that , normally if it was an affair i would leave it to you but in this case i say talk to your husband and file an fir against that creep and make hin pay for taking advantage of women , the option is still urs but i will recommend to give that creep a lesson

its hard to believe that you did not get the feeling that it was not your husband by touch..scent.. how did he gain access to your room while you were asleep? what he did with you was wrong..but will you be able to prove that it was done without your consent since you said you co-operated..since he has asked you to forget about it..let it be bygone..more importantly think how your relationship with your husband and sister will change once you decide to tell..

You are an adult, if you want to continue this relationship, its upto you.  But keep in mind, if you are utterly truthful on what you have mentioned here, then law is in your side. 

Indian Penal Code, section  375. Rape

A man is said to commit "rape" who, except in the case hereinafter excepted, has sexual intercourse with a woman under circumstances falling under any of the six following descriptions:-

First- Against her will.

Secondly,- Without her consent.

Thirdly-   With her consent, when her consent has been obtained by putting her or any person in whom she is interested in fear of death or of hurt.

Fourthly- With her consent, when the man knows that he is not her husband, and that her consent is given because she believes that he is another man to whom she is or believes herself to be lawfully married.

Fifthly - With her consent, when, at the time of giving such consent, by reason of unsoundness of mind or intoxication or the administration by him personally or through another of any stupefying or unwholesome substance, she is unable to understand the nature and consequences of that to which she gives consent.

Sixthly - With or without her consent, when she is under sixteen years of age.

Indian Penal Code Section 452: House Trespass after preparation for hurt, assult or wrongful restraint

Whoever commits house-trespass, having made preparation for causing hurt to any person or for assaulting any person, or for wrongfully restraining any person, or for putting any person in fear of hurt, or of assault, or of wrongful restraint, shall be punished with imprisonment of either description for a term which may extend to seven years, and shall also be liable to fine.

You can file a Police complaint based on the above two sections. If it happened last night, you should get your Medical done with proof of his act, such as DNA present in your body as soon as possible. Law allows 48/72 hours, but sooner you do, the better. If there is no proof, that would be hard to establish.

Again, in case you mess up on this and your husband gets suspicious that it was a consenting sex you had and now trying to prove as rape, which couldnt be established, then he can go for

Indian Penal Code Section 497 Adultery

Whoever has sexual intercourse with a person who is and whom he knows or has reason to believe to be the wife of another man, without the consent or connivance of that man, such sexual intercourse not amounting to the offence of rape, is guilty of the offence of adultery, and shall be punished with imprisonment of either description for a term which may extend to five years, or with fine, or with both. In such case the wife shall be punishable as an abettor.

Here you can make sure he gets a sentence, but your chance of getting sentence increases too.

Sir, first of all definition of rape as provided by you u/s 375 of IPC is amended, though the act committed with her, still comes under the purview of rape. Second thing please make correction in your provision of S.497 of IPC and substitute "In such case the wife shall not be punishable as an abettor" in place of "In such case the wife shall be punishable as an abettor"

Thanks Ricks25 for pointing out. Sorry for the mistakes in a hurry.  I am revising here. Section 375 has been amended with the following. 

375. A person is said to commit “sexual assault” if that 
person–– 
 (a) penetrates his penis, to any extent, into the vagina, mouth urethra or anus of another person or makes the person to do so with him or any other person; or 
(b) inserts, to any extent, any object or a part of the body, not being the penis, into the vagina, the urethra or anus of another person or makes the person to do so with him or any other person; or 
 (c) manipulates any part of the body of another person so as to cause penetration into the vagina, urethra, anus or any part of body of such person or makes the person to do so with him or any other person; or 
 (d) applies his mouth to the penis, vagina, anus, urethra of another person or makes such person to do so with him or any other person; 
(e) touches the vagina, penis, anus or breast of the person or makes the person touch the vagina, penis, anus or breast of that person or any other person, except where such penetration or touching is carried out for proper hygienic or medical purposes under the circumstances falling under any of the following seven descriptions:–– 
First.–– Against the other person’s will. 
Secondly. –– Without the other person’s consent. 
Thirdly. –– With the other person’s consent when such consent has been obtained by putting such other person or any person in whom such other person is interested, in fear of death or of hurt. 
Fourthly. –– When the person assaulted is a female, with her consent, when the man knows that he is not her husband and that her consent is given because she believes that he is another man to whom she is or believes to be lawfully married.
Fifthly.–– With the consent of the other person when, at the time of giving such consent, by reason of unsoundness of mind or intoxication or the administration by that person personally or through another of any stupefying or unwholesome substance, the other person is unable to understand the nature and consequences of that action to which such other person gives consent. 
Sixthly. –– With or without the other person’s consent, when such other person is under eighteen years of age. 
Seventhly. –– When the person is unable to communicateconsent.
Explanation 1.–– Penetration to any extent is “penetration” for the purposes of this section. 
Explanation 2.–– For the purposes of this section, “vagina” shall also include labia majora.
Explanation 3.–– Consent means an unequivocal voluntary agreement when the person by words, gestures or any form of non-verbal communication, communicates willingness to participate in the specific act: 
Provided that, a person who does not physically resist to the act of penetration shall not by the reason only of that fact, be regarded as consenting to the sexual activity. 
Exception.–– Sexual intercourse or sexual acts by a man with his own wife, the wife not being under sixteen years of age, is not sexual assault.
 
And again you are right about 497, I made a mistake there. It should be "In such case the wife shall not be punishable as an abettor".  That gives a clean cheet to wives all the time, no matter if she keeps having sex with other men in front of the husband, all he can do is sue the male, not the wife. He can file for divorce, but cannot sue the wife for aduletry.  Lucky wives!!

Nice story. I can only think of two instances when this is possible. One, when you are drunk and not able to tell the difference bewteen your husband and someone else having sex with you. Second, is when you want it to happen and so keep your eyes closed pretending to be asleep through the episode.

You have not told us if either of my presumptions are true. Very rarely will one sleep so deeply through all the love making unless as I  have said before, one is drunk. Either you do not know your husband very well or you dont care. Every individual has his unique style of love making. Either he will concentrate on sucking the breasts or massaging the breast or fingering the vagina etcin some sequence. Your brother in law, seems to know your husband's sequence rather well. 

You have said that your husband comes home late. Acceptable. You have not told us what your sister's husband was doing at your place. Was his wife in the house. I can bet, that if you both are not having an affair, he would not dare have sex with you, with his wife in the same house/room. For some reason he was confident, that you would not shout and draw your sister's attention.

As everybody said, I won't suggest you to go to the police because it is very easy for advising purpose, but in practical its very hard to go on this way.
Now, let me come to your situation. It is pretty understandable that you are in big dilemma that whether you should reveal this incident to your husband and  sister or not?
According to me you have two ways and on which you should need to go, is depends totally on your observation.
If you think that it shall not happen again, then I think you should not reveal this thing to anybody and forget this like a nightmare, but if you think that your Sister's husband may again try to commit such incident with you, then firstly you should tell this thing to your sister, not to your husband because telling to husband may disturb your married life. Hence tell this thing to your sister and ask her to control her husband. Further, try to live far with your sister's husband and not allow him to come in your house as much as you can.

How come a woman doesn’t recognize her husband among other by the way he touches her body? Leave alone touch, you must have felt some difference with your brother-in-laws penis at least because there must have been some difference in it; also taking into account that its your 1st time your brother-in-law he must have acted a little tensed or worked up while touching you unlike your husband who must take his sweet little time in enjoying your body, so unless you figure out why you didn’t realize all these, I would call it a story.

You also got to answer a few questions here: what was your brother-in-law doing in your house in the mid-night; where was your sister; where was your husband present while you were being fucked? I’m really surprised you din’t at least hear some moans or groans from your brother-in-law while getting fucked because thats the least any guy would feel while fucking. Considering the fact that your brother-in-law has been eyeing you for some time now, he must have let out a few sounds, so your account of the happenings doesn’t match up.

I think this is either a story you’ve made up or you have let him fuck you and are merely covering up to look clean. If this were true, I bet he is coming back for more, so settle in for the long-haul.

You are really in a problem? 1) If you tell to your husband, he will first question to you only 2) If you don't tell to your husband and don't take action, yours sisters husband will force you for sex again.3) If your husband and sisters husbands are good friends and your husband has permitted your sisters husband (some husbands have such fantasy) and if you don't tell to your husband, then also you will have problem.

First you find out how your sisters husband got all the courage to fuck you at a time when your husband is supposed to come and fuck you. You can directly ask your sisters husband whether he has talked with your husband before doing this act and tell him you are going to talk with your husband as well as you sister. From his answer you will come to know whether your husband is aware of it or not. If your husband is not aware of it then you tell to your sister so that she will control her husband. But if your husband is aware of this then you talk with him and take a decision mutually.

Yes, Shanti. I agree with your view point and analysis too. I think, she should first speak with her sis about this. It is more easier for deepti (if it is very true identity and truely happened event) to reach out to her sister, rather than her sister's hubby to raise her concern and know the facts.

i think as per my opinion  this is a kind of rape and you might refer it police but i think a sort of discussion is a must. it might be hard but you must discuss it with your husband .as in the future the things happened in past might affect your married life also this is in your favor that you scolded him also discussion must be so that it wont affect your sisters life too

Deepti you are raped down. You can charge case against him. But how is it possible that you didn't recognise your husband. Every person has different style. This is unbelievable but if you want to close this issue then finish this here and never indulge with him in future. After all it's the question of two families. Think wisely and act wisely. If this happens again then you should go through law.
